CONSTITUTION OF THE BLACK SUN INITIATIVE

SECTION 1. Preamble


This document is hereby created to protect the rights and freedoms of the nations of the Black Sun Initiative (BSI) and govern the parameters of their interaction. The Black Sun Initiative is an alliance which embraces and promotes world peace, freedom and prosperity for all. The Black Sun Initiative recognizes that in order to uphold these principles, for not only the Black Sun Initiative, but also for their allies, the use of diplomacy, financial aid, trade sanctions, military force, or any other means, to be determined at an appropriate time, may be required to preserve the peace and freedom it seeks. The Black Sun Initiative respects the rights of all nations to govern as they please while abiding by this document during their membership.

SECTION 2. Membership

A. The ability to apply for membership in the Black Sun Initiative is open to all members of the CyberNations community. To join the Black Sun Initiative, an applicant must:

* change to black team (this can be waived at the discretion of the Internal Affairs staff),
* not be on any ZI, PZI or EZI lists,
* not be in any active wars.

B. All applications to the Black Sun Initiative will be handled by the Minster of the Interior (or their designated staff) under the direction of Parliament, who may accept, reject, or refer any applications to Parliament for consideration. Applications will be submitted in a manner prescribed by Minster of the Interior (or their designated staff) under the direction of Parliament, and must include such information as they require.

C. Any member may be expelled or otherwise punished, upon trial and conviction by the Court, for reasons including, but not limited to:

* declarations of war on an Black Sun Initiative member or ally,
* unauthorized declarations of war on any nation,
* membership in another alliance,
* forwarding information to other alliances,
* disobeying the lawful order of a superior, or the Court,
* actions unbecoming of an Black Sun Initiative member.

D. Members of the government, at any level, who are before the Court on threat of expulsion shall, at the discretion of the Chief Justice, have their governmental duties, privileges, and powers suspended during the proceedings.

SECTION 3. Parliament

A. The Parliament shall consist of the Prime Minister, Minister of Finance, Minister of Internal Affairs, Minister of Foreign Affairs and Minister of Defence. It can issue binding rulings on any matter pertaining to the Black Sun Initiative. The Parliament retains the authority to:

* approve decisions to declare war,
* issue binding directives to Ministers regarding the execution of any Ministerial power or duty, veto the implementation of Ministerial programs, and request documentation of programs be submitted for review before implementation,
* approve all treaties with foreign alliances,
* propose, vote upon and make amendments to this Constitution.

B. All votes in Parliament will not exceed 48 hours in length.

SECTION 4. Government and Judiciary

A. The Ministers are the officials responsible for the proper operations of their assigned Ministry, and serve within Parliament. Duties of each Minister are as follows:

Prime Minister is responsible for:

* mediating debates within Parliament,
* acting as the alliance's public spokesperson and figurehead.

Minister of Defence is responsible for:

* conducting/executing military operations during times of war,
* researching and communicating strategies for use in war,
* regulating military actions and activity,
* directing the Military Squadrons and its staff,
* approving or denying raids,
* maintaining a list of rules and regulations in regards to raiding.

Minister of Foreign Affairs is responsible for:

* the selection of ambassadors to all alliances,
* the sending and receiving of embassies,
* the negotiation of treaties with alliances or submission to Parliament,
* informing Parliament on current military matters and operations as they pertain to foreign relations.

Minister of the Interior is responsible for:

* upkeep of the alliance roster,
* recruitment of outside nations to the alliance,
* acceptance or denial of applicants,
* education of new members in both nation management and alliance structure, programs, and resources.

Minister of Finance is responsible for:

* managing and directing the economic growth and stability of the alliance,
* organizing alliance-wide growth programs,
* overseeing trade, technology, and other financial programs,
* directing the distribution of war and rebuilding aid, in consultation with the Minister of Defense.

B. Ministers are responsible for appointing their own staff and subordinates. Ministers are also in charge of regulating own their ministries, as long as such regulation does not supersede this document. These regulations and appointments are subject to oversight by Parliament.

C. Excluding the Prime Minister (who shall serve a life term), Ministers shall serve three month terms as elected by a general election. In case of vacancy, one member of the alliance shall be selected as a replacement by the Prime Minister.

D. The judicial power of the Black Sun Initiative to resolve cases and controversies shall be vested in the Chief Justice, who will head the Supreme Court. The Chief Justice shall be appointed by Parliament. A Chief Justice shall continue to serve until they resign.

The Chief Justice is responsible for:

* reviewing cases of complaints by any member of the alliance,
* issuing subpoena's to any member of the alliance to aid in a case,
* amending the Constitution, if necessary, through a judgement,
* conducting all elections,
* issuing disciplinary action to members found to have broken this Constitution or relevant regulation,
* clarifying and interpreting treaties and regulations.

E. Impeachment is the process by which a member of the government is removed from their position. A petition for impeachment must be submitted to the Chief Justice, along with the names of five sponsors, or may be initiated unilaterally by the Chief Justice. The Chief Justice will then review and decide upon the case.

F. Any member may, with good cause shown, petition the Chief Justice to suspend the governmental duties, privileges, and powers of any official who is the subject of an impeachment vote. Said suspension, if approved, shall be retroactive to the time of the request and be automatically lifted at the conclusion of the impeachment hearing.

SECTION 5. Elections

A. Elections shall occur on the second Monday, in the month of election, preceeded by a campaign period which will begin on the first Monday of that month and will end on the Sunday before the election.

SECTION 6. Military and War

A. The Black Sun Initiative recognizes a military code of conduct is necessary to ensure honor and organization in wartime. As such the following rules shall be enforced by Parliament:

* all declarations of war on aligned nations or alliances must be approved by a majority of Parliament,
* declaration of war on rogue nations must be approved by either the Minister of Defence (or designated staff thereof), the Prime Minister, or Parliament,
* nuclear weapons shall not be used unless authorized by the Minister of Defense,
* any aid to foreign nations at war must be approved by Parliament,
* during times of open war, military staff members or Parliament may designate target(s) free to attack for any period of time.

SECTION 7: Amendments

A. Amendments to this Constitution can be proposed by any member of the alliance. They will then be submitted to Parliament, who will then vote upon the change. Any amendment to the Constitution must be approved by a majority vote.

B. Amendments can also be discussed, proposed, reviewed and voted upon by Parliament, without the need for consultation with the general membership of the alliance.

SECTION 8. Individual Rights

A. Recognizing that free and open discussion is necessary for the survival of an alliance, unreasonable restrictions shall not be imposed on the freedom of speech or of the press or to petition the government for a redress of grievances.

B. No member shall be twice put in jeopardy of criminal punishment for the same offense; nor shall be compelled in any criminal case to be a witness against himself.

C. In all criminal prosecutions, members shall enjoy the right to a fair and speedy trial; to be informed of the evidence, witnesses, and charges against them; to have compulsory process for obtaining evidence in their favor; to be presumed innocent; and to enlist counsel to assist with their defense.
